Principle of legal certainty in reports approved after the deadline in the Office of the Comptroller General of the State
Abstract
We sought to analyze legally and doctrinally the figure of expiration applied to the audit reports approved extemporaneously by the control entity in 2018, in cases of the province of Loja, not observing the provisions of Article 26 of the Organic Law of the Comptroller General of the State and identify the possible causes that generated the approval of these reports outside the 180 working days mandated by the aforementioned rule, an act that violates the principle of legal certainty. For this purpose, we have reviewed doctrine, legal bodies such as the Constitution of the Republic of Ecuador, the Organic Law of the Comptroller General of the State; criteria of several jurists about some concepts that were necessary to address such as governmental control, as well as jurisprudential rulings of both the Constitutional Court and the National Court of Justice, issued with respect to the subject developed.
